Benzene has been shown to be a toxic chemical that has been shown to cause cancer. A former Boeing worker died of Leukemia in August. His family believes Boeing, his employer, should be held responsible for his death because they failed to warn him of the risks and failed to provide him with necessary safety equipment. The family is now working to keep other workers from suffering the same fate. Mike Scott, the Boeing employee died. Boeing is denying his claim. Other employees are coming forward saying chemicals at Boeing also injured them. One of these Boeing workers is fighting for his life. Other coworkers are worried for their own health, despite a government investigation showing no problems and Boeing is still not admitting fault. Mike's widow says it's hard to believe. The OSHA report looked at air quality in only one section during only one shift on one day. It showed no employees were exposed to hazardous levels of Benzene or Benzene derivatives. Those are the chemicals Scott's doctors told him caused his leukemia. This testing was inadequate. It’s wrong for companies who know their employees are working with dangerous chemicals not to provide these employees with all safety information and tools available to them to protect their lives.

Benzene lawsuits are filed against the manufacturers of products that contain harmful levels of benzene and other parties that are responsible for dangerous exposure to this toxic carcinogen. The federal government has been regulating benzene for decades, since it was discovered that benzene causes serious adverse health effects from long and short term exposure. You can be exposed to this chemical by inhalation of contaminated air, by consumption of contaminated drinking water, and through exposure to benzene-containing products in the work or other environment. Auto emissions of benzene into the air account for eighty five percent of total ambient air emissions with industrial sources accounting for the other fifteen percent. Other products that contain benzene include: paints, plastics, drinking water, rubber, resin, gasoline, pesticides, detergents, printing materials, lubricants and synthetic fabrics.

A 52-year-old man struck by a car Tuesday morning on the access road of State Highway 6 died several hours later at a local hospital, becoming the fourth pedestrian to die in a Waco area wreck in the last three weeks. W.M. Charles Kinzbach, a newly hired employee of Goodwill Industries, was picking up trash while crossing the intersection of eastbound Highway 6 at U.S. Highway 84 just before 9 a.m. He was still in the middle of the intersection when the traffic light turned green, said Megan Lee, a Tribune-Herald employee who was stopped in her vehicle at the intersection as Kinzbach was crossing. "He looked at me as if to say, 'Do I cross or not?'" Lee said. She said she motioned for him to go, then continued driving. "I drove forward and that's when I heard it, a series of quick thuds," said Lee, who saw a van "moving quickly" from the corner of her eye in the lane next to hers. "I knew immediately what had happened and I got this sick feeling," she said. Kinzbach was struck by a Chevrolet commercial van in the left lane and rolled several feet from where he was hit, Lee said. She said she never heard the squealing of brakes and believed the van must have "plowed over him." Waco Police spokesman Steve Anderson said Kinzbach died at 1:18 p.m. at Hillcrest Baptist Medical Center. Several precautions are taken with Goodwill Industries employees who pick up trash on the highways, said Dan Nisley, president of the Heart of Texas Goodwill Industries. "They receive training and a manual with safety-specific instructions for their jobs," Nisley said. He said employees put out traffic signs that warn of workers and crew members wear hard hats and bright orange vests. Lee said Kinzbach was wearing an orange vest and she noticed he had severe head trauma after the accident. His hard hat, she said, was lying on the gravel several feet from his body. "We've been doing this for 25 years at least and (a fatality accident) hasn't happened before," Nisley said. He said workers start cleaning up streets at 7:30 a.m. and work in groups of at least five, including one crew leader. Police said no one else was injured and no citation was issued. It was the second major auto-pedestrian wreck in the Waco area this month. A 79-year-old Beverly Hills man and two of his great-granddaughters died after they were struck by a sport utility vehicle while they tried to cross South Valley Mills Drive on March 6.

Here is another inspiring story of a community coming together to try to make their roadways safer for children. After an accident injured two children, residents urged traffic controls, but the city refused. Residents voiced their desire for a full traffic signal at Jefferson Avenue and Chapel Lane during a community meeting Tuesday night. Some gave emotional appeals concerning a recent accident at the intersection that seriously injured two middle school students, while others spoke of the broad concern about traffic in the area. Midland resident Mark McAdon said the intersection needs a traffic signal for safety. "Putting in the red, yellow and green light is the only thing that's going to stop this from happening (again) in three years," he said. At the meeting City, Engineer Brian McManus repeated comments he gave at Monday's City Council meeting about the intersection not meeting any of the 11 state-set standards for installing a traffic signal. McAdon said the council should look beyond those triggers. "I think there ought to be rule 12: Two kids get hurt, throw out the rules and listen to the neighbors," he said. McManus said the council has the final say over what happens at the intersection. "City Council does have the right to put in the light and waive those standards," he said. Midlander Marianne Riley questioned the timing of the study done to determine if there is a need for a signal. She said it was done in December and missed about 15 minutes of time when children cross the intersection. McManus said the date was chosen as close as possible to when the study was requested, and the times studied are chosen in coordination with the police. He said pedestrian crossing figures are compared to those given by crossing guards. At the council meeting Monday, Midlander Ryan Ruszala spoke against adding a light when traffic engineers say it is unnecessary. Our law firm has successfully handled negligent highway design cases like this one. Prior warnings, complaints, accident statistics, and pedestrian counts can potentially make this case a case against the city for negligent roadway design. Best of luck to the residents of this city in trying to get the city to make the roads safer.
